Panel to Hear Edwards v. Peoplease

Earlier this month, the Tennessee Workers’ Compensation Appeals Board reached different conclusions in Edwards v. Peoplease on the medical causation issue, in this case involving the alleged aggravation of a preexisting condition. The majority concluded Edwards did not prove the injury and need for knee replacements arose primarily from work but rather the employee’s preexisting arthritis, while the dissent found that the work accident hastened her need for the recommended surgery.

We summarized the opinion and promised we’d let you know if a Supreme Court Special Workers’ Compensation Panel is going to weigh in.

The answer is YES, Ms. Edwards’ counsel filed a notice of appeal on July 11. The snow might be flying before the Panel reaches its decision. But when they do, we’ll let you know the outcome.
